Sure, we all wanna be cool. Or unique. Or trendy. But sometimes being average is great too. Like when a cutting-edge company wants to test an ultra high-speed broadband network in cities across the country. Then representing the average American city becomes, well, kind of important.

When you compare the demographics of the Dayton Region with the overall United States (thank you census data), you'll see that we fall pretty much right in line with average America. Populations broken down by age. Educational backgrounds. Occupations we pursue. Income earned by our residents. We are the ideal American location.

This is your chance to see what average America can accomplish with the most advanced Internet technology available. No, we're not strangers when it comes to innovation (see our awesome accomplishments), but this network opens doors we've yet to explore. So, let's see how the just average Dayton Region can forever change the lives of Americans all over again.

Are you a little skeptical right now? Are you wondering how this small, Midwestern city can call itself awesome? We're sounding pretty arrogant, huh? Ok…we'll prove it.

Most people know the Wright Brothers built their first flying machine in Dayton, Ohio, where Charles Kettering also developed the automobile self-starter. The cash register—and later the electric cash register—was invented in Dayton. And Dayton's own Joseph Desch and his team of engineers developed the first U.S. code-breaking computer, helping the Allies avoid German U-boats and shortening World War II.

But that's not all. There are countless other inventions that you probably had no idea came from Dayton. The stepladder. Motor fuel. The collapsible crib. The artificial heart. Parking meters. The pop-top tab. A parachute that could be opened by its operator. The motion picture projector/theater. We could go on and on, but we think you get the point.

And our inventions aren't just a thing of the past. As times and technology have changed, so have our ideas. Advanced sensor technology, radio frequency identification, fuel cell systems, micro air vehicles and visualization/computing technologies are a few of the areas we're currently exploring in the Dayton Region.

So, while we may live in a typical American city in the middle of the country, we are by no means average when it comes to our impact on history. We're innovative, inquisitive and anything but complacent. We've made a name for ourselves by inventing ways to improve the lives of people all over the world. And that's pretty awesome.

OR
SLIGHTLY BETTER (OR POTENTIALLY WORSE) THAN A HANDSHAKE AGREEMENT

This Agreement (the "Agreement”) is made as of __________________, 2010 (the “Effective Date”), by and between¹ GOOGLE, INC. (also to be referred to herein and hereinafter² as “the company that revolutionized the ultra-high speed broadband network environment as a result its trial location in Dayton, Ohio”) and DAYTON, OHIO (also to be referred to herein and hereafter as “the city that revolutionized the ultra-high speed broadband network environment as a result of partnering with Google as a trial location”), which will collectively be referred to hereinafter³ as the “REVOLUTIONIZING PARTIES”) under the following circumstances:

WHEREAS GOOGLE is a global technology leader focused on improving the ways people connect with information, and its mission is to organize the world’s information and make it universally accessible and useful [in fact, so much so that its name has now become a household word and is synonymous in virtually any language with finding useful information (i.e., “googleing” something)].

WHEREAS DAYTON, OHIO, is “average” because it is made up of a good cross section of America that is an ideal testing environment and is “awesome” because, as a community, it has been inventing or improving things for years, including, among other things, pioneering flight with the Wright brothers, RFID, Advanced Health Sciences, and micro air vehicles (it would be too tedious and exhausting to list all of them here, but trust us, Dayton rocks).

WHEREAS GOOGLE is planning to build, and test ultra-high speed broadband networks in a small number of trial locations across the country and intends to deliver Internet speeds more than 100 times faster than what most Americans have access to today with 1 gigabit per second, fiber-to-the-home connections and its offer service at a competitive price to at least 50,000, and potentially up to 500,000 people.

WHEREAS DAYTON, OHIO, is interested in partnering with GOOGLE to deploy its ultra-high speed broadband networks testing environment efficiently and quickly in the Dayton community.

WHEREAS GOOGLE and DAYTON, OHIO, agree that, given all the nice and completely accurate things we have just written, it would be ridiculous and unreasonable to choose any community other than DAYTON, OHIO, as the trial location for testing.

NOW, THEREFORE, in consideration of the mutual benefits and obligations contained in this Agreement, the REVOLUTIONIZING PARTIES agree to the foregoing and as follows:

1. Contract and Agreement. Pursuant to their mutual good conscience, honor as world community members, and swearing at peril of the loss any dearly and closely held personal property, such as their respective Chia Obamas, the REVOLUTIONIZING PARTIES hereby agree that DAYTON, OHIO will be selected as the test site for GOOGLE’S ultra-high speed broadband network trial.
2. Performance. The REVOLUTIONIZING PARTIES hereby agree to use their best efforts to make DAYTON, OHIO the best possible testing environment and to reach somewhere between 50,000 and 500,000 potential customers.⁴
3. Term and Termination.
   1. Term. The term of this Agreement shall begin on the execution hereof and shall continue until it is over.⁵
   2. Termination.
      1. GOOGLE may terminate this Agreement immediately for any reason upon providing a reasonably plausible excuse for such termination to DAYTON, OHIO, in a written notice; DAYTON, OHIO, would prefer that if GOOGLE exercises its right to terminate that it provide an excuse that will allow DAYTON, OHIO, to claim to the area media that the termination was a result of East Coast or West Coast bias, bias against the Midwest, or some other bias, as its creativity may dictate.⁶
      2. DAYTON, OHIO, may terminate this Agreement with a written notice for any reason or for no reason at all, but would not think of doing so.⁷
   3. Effect of Termination.
      1. The Agreement is terminated (i.e., it is over).⁸
4. Relationship of Parties. The REVOLUTIONZING PARTIES agree that each of them is acting as an independent contractor in connection with its respective responsibilities under this Agreement. Nothing contained in this Agreement shall be construed to indicate that the Parties are entering into any kind of joint venture, partnership, communal living arrangement, brotherhood, sisterhood, fraternal order, or maternal order. However, a joint party together at some point would be nice.
5. Partial Invalidity. If any term or provision of this Agreement or the application thereof to any entity, person or circumstance shall, to any extent be held invalid or unenforceable, the remainder of this Agreement, or the application of such term or provision to entities, persons or circumstances other than those as to which it is held invalid or unenforceable, shall not be affected thereby, and each remaining term and provision of this Agreement shall be valid and enforceable to the fullest extent permitted by law.⁹
6. Entire Agreement. This instrument embodies the entire agreement of the REVOLUTIONIZNG PARTIES related to the subject matter contained herein. There are no promises, terms, conditions or obligations other than those contained herein (except that DAYTON, OHIO, might seeks some additional preferential g-mail and ‘sponsored links’ benefits as a result of its contacts made with GOOGLE during the negotiations, but we can discuss that later); and this Agreement shall supersede all previous communications, representations or agreements, either written or oral, between the REVOLUTIONIZNG PARTIES to this Agreement. Also, this Agreement shall not be modified in any manner except by tearing it up and throwing it in the garbage, if necessary.
7. Counterparts. This Agreement may be executed in two or more counterparts¹⁰, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument.
8. Governing Law. This Agreement and any modifications, amendments, or alterations, shall be governed, construed, and enforced under Murphy’s laws.¹¹

IN WITNESS WHEREOF, the REVOLUTIONIZNG PARTIES have set their hands effective on the date first written above.
